These Terms of Service (“Terms”) govern your access to and use of the website, mobile application, software, products, and services provided by Plutus Homes, LLC (“Plutus Homes,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to these Terms.

1. Plutus Homes Services

Plutus Homes is a technology company that develops and operates software products and related technology services. Features and functionality available through the Services may change from time to time.

2. User Accounts

Certain Services may require you to create or access an account. You agree to provide accurate information and to keep your account information reasonably current.

You are responsible for maintaining the confidentiality and security of your account credentials and for activities occurring through your account.

You should notify us at support@plutushomes.ai if you believe your account has been accessed without authorization.

3. SMS Authentication and OTP Messages

Plutus Homes uses SMS messages for login, authentication, and account verification purposes only.

When you enter your mobile phone number and select “Send OTP,” “Get Verification Code,” or a substantially similar option in the Plutus Homes application, you expressly request and consent to receive a one-time SMS verification code from Plutus Homes at the mobile number you provided.

The SMS is sent in response to your authentication or verification request.

Message frequency depends on the number of login or verification requests you initiate. Message and data rates may apply.

Plutus Homes does not use this SMS program to send marketing or promotional messages.

Mobile carriers are not liable for delayed or undelivered messages.

4. SMS Consent

You should provide only a mobile number that you own or are authorized to use. By requesting an OTP or verification code, you represent that you are authorized to receive messages at the mobile number provided.

Your mobile number and SMS consent information will not be sold or shared with third parties or affiliates for their marketing or promotional purposes.

5. Acceptable Use

You agree not to misuse the Services. You may not use the Services to engage in unlawful activity; interfere with the operation or security of the Services; attempt to gain unauthorized access to systems or accounts; circumvent authentication or security measures; distribute malicious software; impersonate another person; or use automated systems in a manner that materially interferes with the Services.

6. Intellectual Property

The Services, including software, designs, interfaces, text, graphics, logos, technology, and other content provided by Plutus Homes, may be protected by intellectual property laws. Except as expressly permitted by Plutus Homes, these Terms do not grant you ownership of or rights to Plutus Homes intellectual property.

7. Third-Party Services

The Services may interact with third-party products, infrastructure, websites, or services. Plutus Homes is not responsible for third-party services that are outside our control. Your use of third-party services may be governed by separate terms and privacy policies.

8. Availability and Modifications

We may modify, update, suspend, or discontinue portions of the Services from time to time. We do not guarantee that every feature will always be available or operate without interruption or error.

9. Disclaimer of Warranties

To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

Plutus Homes disclaims warranties that are not expressly provided in these Terms to the maximum extent permitted by applicable law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Plutus Homes and its officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

11. Termination

We may suspend or terminate access to the Services if we reasonably believe a user has violated these Terms, created security risks, engaged in unlawful activity, or misused the Services. You may stop using the Services at any time.

12. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the Effective Date and may provide additional notice when required by applicable law.

Continued use of the Services after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.

13. Governing Law

These Terms will be governed by applicable laws of the United States and the applicable state law determined by Plutus Homes' principal place of business, without regard to conflict-of-law principles.
